Terms of Service

Hello and welcome! We are glad that you are taking the time to read these terms of service (the “Terms”).
These Terms are important as they, together with your booking confirmation email (the “Booking Confirmation”), set out the legal terms on which Travel Services are made available to you through our Service. They also cover any interactions or communications you have with us through our Service.
Your use of our Service is conditioned upon your acceptance of these Terms. To book a Travel Service, you must also accept these Terms. If you do not accept these Terms, then please do not use our Service or book a Travel Service.
We may change these Terms at any time and your future use of our Service following changes to these Terms is subject to you accepting those updated Terms. We recommend that you save or print a copy of these Terms.
Section 14 of these Terms contains an arbitration procedure and class action waiver that apply to all claims brought against us in the United States. Please read them carefully.
In these Terms:

“we," “us” or “our” refer to Vuelos Caribe Corp., a company incorporated in Florida, USA, having its registered office at 7901 4th Street North, 300, St. Petersburg, FL 33702, which provides our Service.

“our Group of Companies” refers to us, and our subsidiaries and corporate affiliates if applicable.

“our Partners” refers to any affiliated, co-branded, or linked website through which our Group of Companies provides content or service.

“our Service” refers to the provision of our websites, apps, and online tools.

“Travel Provider” refers to the travel supplier making available the Travel Services to you through our Service.

“Travel Services” refers to the travel services made available to you by the relevant Travel Provider(s) through our Service, such as stays at a property, flights, car rental, cruises, worldwide tours, local attractions, or things to do.

“you” refers to you, the traveler, using our Service or making a booking with our Service.
Please read these Terms carefully.
Section 1: Rules and Restrictions As well as these Terms, other terms and conditions provided by Travel Providers (such as an airline’s conditions of carriage, a property’s terms and conditions, a car rental company’s rental agreement, etc.) also apply to your booking (“Rules and Restrictions”).
To make a booking, you must accept the Rules and Restrictions of the Travel Provider that you select (such as payment of due amounts, refundability, penalties, availability restrictions, and use of fares or services, etc.). The relevant Rules and Restrictions are provided to you before you make a booking and are incorporated by reference into these Terms.
If you violate a Travel Provider's Rules and Restrictions, your booking may be canceled, and you may be denied access to the relevant Travel Service. You may also lose any money paid for such booking, and we or the Travel Provider may debit your account for any costs we or they incur as a result of such violation.
Section 2: Using our Service Our rules: We provide our Service to help you find information about Travel Services and to assist you in booking those Travel Services. It is provided to you for no other purpose.
You agree that:

You will only use our Service for personal and non-commercial purposes.

You must be at least 18 years of age and have the legal authority to enter into contracts.

You will use our Service lawfully and in compliance with these Terms.

All information supplied by you is true, accurate, current, and complete.

If you have an account with us, you will:

Safeguard your account information.

Be responsible for any use of your account by you or others.

If you book on behalf of others:

You will obtain their authorization prior to acting on their behalf.

You will inform them about the terms that apply to the booking (including the Rules and Restrictions) and ensure that they agree to such terms.

You are responsible for paying any amounts due, for making any change/cancellation requests, and for all other matters relating to the booking.
You also agree not to:

Make any false or fraudulent booking.

Access, monitor, or copy any content on our Service using any robot, spider, scraper, or other automated means or any manual process.

Violate the restrictions in any robot exclusion headers on our Service or bypass or circumvent other measures employed to prevent or limit access to our Service.

Take any action that imposes, or may impose, an unreasonable or large load on our infrastructure.

Deep link to any part of our Service.

“Frame,” “mirror,” or otherwise incorporate any part of our Service into any other website.
Access: We may, acting reasonably, deny anyone access to our Service at any time for any valid reason. We may also make improvements and changes to our Service at any time.
Account: To create an account, you must be at least 18 years of age and follow the account creation instructions provided through our Service.
The account you create on our Service also allows you to access other sites, apps, tools, and services offered by members of our Group of Companies using the same account credentials, in addition to our Service (a “Vuelos Caribe Account”). Please note that when using your Vuelos Caribe Account, the relevant terms of service displayed on the sites, apps, tools, and services that you are using will govern your use of them.
For information on how to delete your account, sign into your account on our Service and follow the applicable account deletion process. For further information about your privacy rights (such as deletion or access), please see our Privacy Statement.
How we order your search results: There are many travel options available through our Service, and we want to make your search results as relevant as possible. At the search results page, you will see our default sort order; however, you can select how to sort your results and also use filter options to prioritize results based on your chosen preferences, such as price, guest review score, or other criteria. You can learn more about how we order search results here.
Within your search results, we also sometimes display travel options that are paid-for commercial listings from our Travel Providers. Such travel options are clearly labeled for your information as “Ad” or similar equivalent labeling, to differentiate them from other travel options.
Redirection and third-party booking services: If you are redirected from our Service to a third-party booking service (such as for car rental) to make a travel booking, please bear in mind that any bookings made through such a booking service will be with the third party and not with us. We are not responsible for bookings made through third-party booking services and we have no liability to you in respect of such a booking. The terms and conditions of the third-party service provider will set out what rights you have against them and will explain their liability to you.
Section 3: Confirming a Booking Your Booking Confirmation includes the essential elements of your booking, such as the description of the Travel Service(s) booked and the price.
We will send your Booking Confirmation and any relevant travel documents to the email address you provide when you book. If you do not receive your Booking Confirmation within 24 hours of making your booking, please contact us.
Section 4: Payment Price: The price of the Travel Service(s) will be as displayed on our Service, except in cases of obvious error.
Prices for Travel Services are dynamic and can change at any time. Price changes will not affect bookings already accepted, except in cases of obvious error. We display many Travel Services, and we try hard to ensure that the displayed price is accurate. We reserve the right to correct any pricing errors on our Service.
If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty. We have no obligation to make available Travel Services to you at an incorrect (lower) price even after you have been sent a Booking Confirmation if the error should reasonably have been apparent to you.
Taxes: The prices displayed through our Service may include taxes or tax recovery charges. Such taxes or tax recovery charges may include amounts associated with value-added tax, goods and services tax, sales tax, occupancy tax, and other taxes of a similar nature.
Taxes or tax recovery charges are generally calculated or estimated on the prices displayed through our Service before any discounts (including those funded by us), coupons, and loyalty rewards that may be applicable to your booking, unless those discounts, coupons, and loyalty rewards are considered as a reduction in price for the purposes of calculating or estimating taxes in the relevant jurisdiction for the booking.
You acknowledge that except as provided below with respect to tax obligations on the amounts received from you, including facilitation fees and service fees where applicable in accordance with Section 6A(Stays) below, our Group of Companies does not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on Pay Now bookings are a recovery of the estimated taxes that our Group of Companies pay to the Travel Provider for taxes due on the services provided by the Travel Provider (such as for the rental rate for the room). The Travel Providers are responsible for remitting applicable taxes to the applicable taxing jurisdictions. Taxability and the appropriate tax rate vary greatly by jurisdiction. The actual amounts paid by our Group of Companies to the Travel Providers may vary from the tax recovery charge amounts, depending upon the rates, taxability, etc., in effect at the time of the actual use of the services provided by the Travel Provider.
Sales, use, and/or local hotel occupancy taxes are imposed on the amounts that our Group of Companies charge for services they provide (service fee and/or facilitation fee) in certain jurisdictions. The actual amount imposed on services provided by our Group of Companies may vary depending on the rates in effect at the time the services are provided by the Travel Provider. In certain jurisdictions, our Group of Companies are responsible for collecting and remitting sales, use, and/or local hotel occupancy taxes for the entire price, including the amounts we charge for our services as well as the Travel Services provided by the Travel Provider.
In certain jurisdictions, you may be responsible for paying local taxes imposed by local tax authorities (such as city taxes or tourist taxes, etc.). Our Group of Companies or the Travel Provider may charge you such local taxes. Our Group of Companies will notify you of any local taxes that will be payable by you before you complete your booking, where such taxes have been notified to our Group of Companies by the Travel Provider.
The amount of local taxes can change between the booking date and stay date. If taxes have changed by your stay date, you may be liable to pay taxes at the higher rate.
Payment processing: For certain Travel Services, such as a Package (as defined in Section 6G(Packages)), payment may be charged by more than one party (as will be shown on your payment method statement); however, the total amount charged will not exceed the total price of all the Travel Services.
When payment is taken at the time of your booking and paid for in the local currency of our Service (as relevant), the company taking that payment (via third-party payment processors) and charging your payment method will be the company set out next to the relevant location of our Service in the table below.
You authorize Vuelos Caribe Corp or the Travel Provider to:

Verify your payment method by obtaining pre-authorization, charging a nominal fee, or using other verification methods.

Upon verification, charge your payment method.
Fees Charged by Banks
Some banks and card issuers may impose fees for international or cross-border transactions. For example, using a card issued in a different country from the Travel Provider’s location or transacting in a currency different from your card's currency may incur international transaction fees. Additionally, currency conversion fees may apply.
For questions about these fees or exchange rates, please contact your bank or card issuer. Vuelos Caribe Corp is not responsible for any fees related to exchange rates or card issuer charges.
Currency Conversion
Currency conversion rates displayed on our website are based on public sources and current exchange rates, which may fluctuate between booking and travel dates. These rates are provided for informational purposes only, and while we strive for accuracy, Vuelos Caribe Corp does not guarantee their correctness due to external factors beyond our control.
Alternative Payment Methods
We may collaborate with alternative payment providers (e.g., consumer finance companies) to offer additional payment options. Vuelos Caribe Corp does not endorse or recommend any specific provider or their products/services. Use of alternative payment methods is at your own risk and subject to the provider’s terms and policies.
Fraud
If we detect signs of fraud, abuse, or suspicious activity related to a booking or account, we may request additional information. If fraud or abuse is reasonably suspected, we reserve the right to:

Cancel associated bookings or accounts.

Take legal action, potentially holding you liable for losses incurred.
Please contact us regarding booking cancellations or account closures.
All refunds will be issued only to the original payment method used at booking. Refunds cannot be issued to a different card or account.
Section 5: Cancelling or Changing a Booking
Cancellation or Change by You
Changes to bookings (e.g., travel date, destination) can be made by contacting us. You acknowledge that you have no automatic right to cancel or change a booking; eligibility is governed exclusively by the Travel Provider’s Rules and Restrictions, which are displayed prominently and accepted by you via checkbox before you complete the booking.
Travel Providers may charge fees for cancellations or changes, as specified in their Rules and Restrictions (which you agree to). Vuelos Caribe Corp. may also charge a separate administration fee of up to US$50 (or equivalent) for processing permitted cancellations or changes; this fee will be disclosed before you confirm the cancellation. Prices for changed arrangements may differ.
Failure to cancel within the provider’s deadlines, no-shows, or late cancellations will result in full forfeiture of the fare with no refund. Some bookings are non-refundable and non-changeable after purchase. Refunds for unused services (when permitted) are subject to the provider’s rules plus these Terms.
Refunds
When a refund is due under the Travel Provider’s rules or applicable law (including U.S. Department of Transportation regulations for flight cancellations or significant schedule changes), we will process it to the original payment method within 5–10 business days of approval. The entity that processed the original transaction will issue the refund.
Please note: Most fares are non-refundable or subject to strict conditions. Refund eligibility and any cancellation/change fees are clearly displayed and require your explicit acceptance during the booking process.
For hotel or property reservations (including all-inclusive experiences, C.A.R.I.B.E. Family Experience, and C.A.R.I.B.E. Family Reunification): If a cash refund is permitted by the provider’s rules, it will be issued as cash to the original payment method or, at our option and with your clear disclosure at the time of cancellation, as a Travel Credit. Travel Credits are non-refundable, non-transferable except with prior written approval, and valid for future bookings through Vuelos Caribe Corp. (no expiration unless stated).
For standalone flight bookings: In cases of no-show or customer cancellation, you may be eligible only for a refund of recoverable airport taxes and fees (we will submit the request to the airline). If the airline cancels the flight or makes a significant change, you are entitled to a full refund in accordance with U.S. DOT rules; we will process this promptly upon notification from the airline.
Other Cancellations or Changes
We (or the Travel Provider) may cancel for non-payment or other valid reasons and will notify you promptly, offering alternatives or a refund where feasible.
Section 6: Travel Service Specific Terms
This section outlines terms specific to Travel Services provided by the Travel Provider. It complements, but does not replace, the Travel Provider’s Rules and Restrictions provided before booking. In case of inconsistency, the Travel Provider’s Rules and Restrictions prevail.
A. Stay At Vuelos Caribe, we offer flexible payment options to enhance your travel experience. Whether you choose Pay Now or Pay Later, we ensure transparency in pricing, including taxes and fees that may vary based on your selection. Here's how each option works:
Pay Now Opting for Pay Now means your booking amount, including taxes and our service fees, will be charged upfront to your chosen payment method at the time of booking. This option provides you with immediate confirmation and peace of mind.
Pay Later Selecting Pay Later allows the Travel Provider to charge your payment method in the local currency upon your stay. This option offers flexibility, especially if your plans might change.
Deposit Certain Travel Providers may require a deposit at check-in to cover incidental expenses during your stay. This deposit is separate from the booking payment and varies by provider.
First Night No-Show If you anticipate missing the first night of your stay but plan to check in later, please notify us in advance to avoid cancellation of your entire booking. Refunds for no-shows are subject to the property's Rules and Restrictions.
Group Bookings For bookings involving more than 8 rooms at the same property for the same dates, please contact us or use our "Groups and Meetings" section. Separate terms and conditions may apply, including potential cancellation fees.
Ratings Property ratings displayed on our platform provide general expectations based on local standards. While we strive for accuracy, actual features and amenities may vary. Refer to the property details for comprehensive information.
Meals If your booking includes meals, the number provided corresponds with the length of your stay. Full board typically includes breakfast, lunch, and dinner, while half board includes breakfast and one additional meal. Unused meals are non-refundable.

C. Flights
Vuelos Caribe Corp acts solely as a travel agent when assisting with flight arrangements. We do not issue airline tickets directly. All flights are booked through third-party travel providers or directly with the airline, and your contract for air travel is exclusively between you and the applicable Travel Provider.
Flight pricing and availability are not guaranteed until tickets are issued by the Travel Provider. Once ticketed, all terms, conditions, and restrictions are governed by the airline or booking provider.
Any refunds, credits, or changes are subject to the policies of the airline or Travel Provider and applicable law (including U.S. Department of Transportation rules where applicable). Vuelos Caribe will assist in submitting and facilitating requests but does not control or guarantee refund outcomes.
Low-Cost Flights
For certain flights, displayed prices may be converted from another currency for convenience and are estimates only. The final amount charged is determined by the airline or provider and may vary due to exchange rates or fees applied by banks or card issuers. You will be shown the final charge before completing your booking.
Some low-cost airlines require changes or cancellations to be handled directly with the airline. Vuelos Caribe may not be notified of such changes, and updates may not appear in your itinerary. We recommend retaining all communications received directly from the airline.
Site Redirection
In some cases, you may be redirected to a third-party provider or airline website to complete your booking and payment. In such cases, your contract is directly with that provider. Vuelos Caribe is not responsible for transactions completed outside of our service.
Flight Terms and Conditions
By booking or arranging flights through our service, you acknowledge and agree that:
- Airlines control their schedules and may modify or cancel flights. We will assist in communicating updates when available, but you should confirm flight details directly with the airline prior to travel.
- Seat assignments are controlled by the airline and cannot be guaranteed.
- If you miss an outbound flight on a roundtrip ticket, the airline may cancel the return segment without refund.
- Some flights may be operated by a different airline than the one shown at booking.
- Airlines may charge additional fees for services such as baggage, meals, or seat selection. These charges are set and collected by the airline.
- All passengers must comply with airline rules regarding children, minors, and travel documentation.
Combined One-Way Tickets
In some cases, we may offer separate one-way tickets instead of a roundtrip. Each ticket is subject to its own terms and conditions. Changes affecting one segment may not apply to the other, and additional adjustments may be required.
Air Miles and Vouchers
Loyalty program benefits, air miles, or vouchers may not be applicable to bookings arranged through third-party providers.
Operating Airlines
Flights marketed by one airline may be operated by another. The airline issuing the ticket is responsible for all charges and will appear on your payment statement.
No-Show or Cancellation
In the event of a no-show or cancellation, you may be eligible for a refund of certain taxes or fees, subject to airline policies. Vuelos Caribe can assist in submitting such requests on your behalf.
Airline Liability
Airline liability for personal injury, delays, or other damages is governed by applicable laws, international conventions, and the airline’s own terms and conditions.
D. Car Rentals
Payment
For car rental bookings, payment may be processed by the Travel Provider rather than our Group of Companies.
Upon collecting the rental car, you or the designated driver must present a valid credit card. Please confirm with the Travel Provider which credit cards are accepted, as debit cards may not be accepted. The Travel Provider may authorize your credit card issuer for a deposit during the rental period, so ensure sufficient credit limit is available. Larger car types may require two credit cards.
Failure to comply with these rules may result in the Travel Provider not making the vehicle available, and per the Rules and Restrictions, you may be liable to pay up to the full car rental price.
Supplements
Additional charges, such as refueling, snow tires, extra driver fees, young driver surcharges, child seats, delivery, and collection fees, may be payable locally to the Travel Provider. Neither we nor the Travel Provider are responsible for these extra charges. Requests for optional extras (e.g., child seats) are subject to availability and cannot be guaranteed.
An insurance excess may apply in case of theft or damage to the rental car, payable to the Travel Provider. The amount varies by Travel Provider and rental country. Opting for extra insurance coverage locally may reduce or eliminate this excess. Neither we nor the Travel Provider are liable for the excess or provision of additional insurance coverage.
Fuel is typically not included in the rental price. Some Travel Providers may charge for refueling upon return of the vehicle. Unless agreed otherwise, return the rental car to the same branch from which it was collected.
Collection and Use of Rental Cars
Drivers are generally required to be aged between 21 and 75, though specifics may vary by Travel Provider and rental country. Verify this information with the Travel Provider. Additional fees may apply for drivers under 25 or over 70 years old.
Upon collection, you or the driver must present a valid full driving license for the rented vehicle category. International rentals may have different license requirements; confirm details with the Travel Provider. For non-Roman alphabet licenses, an international driving license may be required, and EU countries may require it for non-EU license holders. Additional documentation, such as a passport or proof of name and address, may be required. For non-Roman alphabet licenses, an international driving license may be required, and EU countries may require it for non-EU license holders. Additional documentation, such as a passport or proof of name and address, may also be needed depending on the rental location.
E. Cruises Some Travel Providers offering cruises may require you to sign their liability waiver prior to participating in the Travel Service they offer.
F. Things to do Some Travel Providers offering Things to do may require you to sign their liability waiver prior to participating in the Travel Service they offer. Things to do Travel Services are not usually transferable nor eligible for refunds or changes unless the Travel Provider cancels such Travel Services.
G. Packages We provide the opportunity for you to book separate Travel Services together at the same time through our Service (for example, a stay booking and a flight booking) but each Travel Service is subject to its own Rules and Restrictions and these Terms (such a combined booking is a “Package”).
Section 7 International travel Travel to certain destinations may involve more risk than others. You must review any travel warnings/advice issued by relevant governments before booking international travel. It is advisable to monitor such travel warnings/advice during travel and before your return journey to minimize disruptions.
Health You should check recommended inoculations/vaccinations which may change at any time. Consult your doctor before departure to ensure you meet all health entry requirements, receive necessary inoculations/vaccinations, take recommended medication, and follow medical advice related to your travel.
Passport and Visa Requirements It is your responsibility to verify and obtain the necessary passports and visas for your travel. Requirements may change, so ensure you have up-to-date information before booking and departure. Allow sufficient time for all applications and approvals. Vuelos Caribe Corp is not liable if you are denied entry onto a flight, cruise ship, or into any country due to insufficient or incorrect travel documents.
Liability Our liability is limited in accordance with the following terms:

We operate our services while travel providers deliver the travel services.

We are not liable for the travel services provided by the travel providers.

We are not liable for acts, errors, omissions, or negligence of travel providers.

We are not liable for personal injuries, death, property damage, or other expenses resulting from the above.
Our Liability
At Vuelos Caribe Corp, we prioritize your travel experience and transparency in our services. Here’s how we address liability:
Service Ownership and Travel Providers : We operate our Service, and Travel Providers offer Travel Services. We are not liable for:* Any Travel Services provided by Travel Providers.

Acts, errors, omissions, representations, warranties, or negligence of Travel Providers.

Personal injuries, death, property damage, or other expenses resulting from Travel Providers' actions. Accuracy of Information : Travel Providers provide us with information about Travel Services, including details, photos, rates, and Rules and Restrictions. While we display this information through our Service, Travel Providers are responsible for its accuracy. We are not liable for inaccuracies unless directly caused by us. Warranties and Conditions : We provide information, software, and Travel Services through our Service without any warranty or condition, including implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, title, or non-infringement. Our Group of Companies and Partners disclaim all such warranties. Endorsement Disclaimer : The display of Travel Services on our Service does not constitute an endorsement or recommendation by us. We disclaim any warranties and conditions regarding the virus-free nature of our Service or emails sent from us or our Partners. Limitation of Liability : To the maximum extent permitted by law, neither Vuelos Caribe Corp nor our Partners will be liable for any direct, indirect, punitive, special, incidental, or consequential losses or damages arising from:* Travel Services.

Use or inability to use our Service.

Delays or disruptions in using our Service.

Your use of links from our Service. Limitation Scope : If we are found liable under these Terms, our liability will be limited to direct damages that were reasonably foreseeable, actually suffered or incurred by you, and directly attributable to our actions. In no event will our liability exceed the cost paid for the Travel Services or one-hundred dollars (US$100.00) or its equivalent in local currency. Force Majeure : Events beyond our control (e.g., communication interruptions, strikes) may suspend our obligations under these Terms. We will not be liable for failing to meet these obligations during such events.
International Travel Advisory We do not guarantee the advisability or risk-free nature of international travel destinations. Vuelos Caribe Corp is not responsible for any damages or losses that may occur during travel to such destinations.
Updates to Policy This Privacy Statement may be updated periodically to reflect changes in our practices or legal requirements. Please review it periodically for any updates.
Cookie Statement Our Cookie Statement provides information about the use of cookies and similar technologies on our website.
Collection and Use of Your Personal Information Details regarding the types of personal information we collect, how we collect and use it, purposes, and lawful bases for processing can be found in this section.
Security We implement robust security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction.
Indemnity You agree to indemnify Vuelos Caribe Corp and our partners against any claims, demands, losses, damages, fines, penalties, or expenses resulting from your breach of these terms, violation of any law or third-party rights, or use of our services.
Reviews, Comments, and Submissions By submitting content to our service, you grant us the right to use, reproduce, modify, and publicly display such submissions. You are responsible for the content of your submissions and must comply with our content guidelines.
Indemnity You agree to defend and indemnify Vuelos Caribe Corp and its partners, and any of their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties, or other costs or expenses of any kind or nature ("Losses"), including reasonable legal and accounting fees, brought by third parties as a result of:

Your breach of these Terms or any documents referenced herein.

Your violation of any law or the rights of a third-party.

Your use of our services.
This indemnity extends to Losses not directly caused by the actions of Vuelos Caribe Corp or its partners.
Section 9: Reviews, Comments, and Submissions
By submitting content to our service, including reviews, photos, videos, comments, suggestions, or other materials (collectively "Submissions"), you acknowledge and agree to the following:

All Submissions are your original creations, and you have all necessary rights to grant Vuelos Caribe Corp and its partners a non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from, publicly display, and perform such Submissions worldwide in any media, now known or later devised.

Vuelos Caribe Corp may use the name associated with your Submission to attribute your content at its discretion.

Submissions may be shared with travel providers.

You grant Vuelos Caribe Corp the right to pursue legal action against any entity that violates your or its rights in the Submissions.

Submissions are non-confidential and non-proprietary.

All Software on our Service is owned by Vuelos Caribe Corp, our partners, or our suppliers and is protected by copyright laws and international treaties. Reproduction or redistribution of the Software is prohibited and may result in severe penalties.
Copying or reproduction of the Software to any other server or location for further reproduction or redistribution is expressly prohibited. Any warranties for the Software are limited to those provided in the License Agreement, if any.

Section 14 Disputes and arbitration
Disputes and arbitration
Please read this Section carefully. It requires that any and all claims be resolved by binding arbitration or in small claims court, and it prevents you from pursuing a class action or similar proceeding in any forum. Arbitration is required if your country of residence enforces arbitration agreements, including without limitation, the United States. If you are outside the United States but attempt to bring a claim in the United States, arbitration is required for determination of the threshold issue of whether this dispute resolution section applies to you, as well as all other threshold determinations, including residency, arbitrability, venue, and applicable law. If your country of residence does not enforce arbitration agreements, the mandatory pre-arbitration dispute resolution and notification and prohibition on class actions or representative proceedings provided below still apply to the extent enforceable by law.
Small claims court matters
Despite the arbitration provisions mentioned earlier, either party may file or transfer any claim to small claims court if it falls within the court’s jurisdictional limit. However, such court cannot handle claims on a class or representative basis, nor can it consolidate or join claims from other individuals or parties in the same proceeding. Additionally, if the claims asserted in any arbitration demand fall within the jurisdictional limit of the small claims court, either party may choose to have the claims resolved in small claims court instead of arbitration. This election must be communicated to the other party in writing before an arbitrator is appointed or in accordance with AAA rules.
No class actions or representative proceedings.
You and we agree that all proceedings to resolve claims will be conducted individually and not as part of a class, consolidated, or representative action, including actions as a private attorney general. The arbitrator may not consolidate claims from more than one party or preside over any form of class or representative proceeding. Both parties acknowledge and waive their right to a jury trial.
Mandatory pre-arbitration dispute resolution and notification
Before initiating arbitration, you agree to give Vuelos Caribe the opportunity to resolve any claims ("Claims") by notifying us of the Claim in writing and attempting in good faith to negotiate an informal resolution.
You must send a written and signed Notice of Dispute ("Notice") by certified mail to: Legal Department/Dispute Resolution Provision, Vuelos Caribe Corp., 7901 4th Street North, 300, St. Petersburg, FL 33702.
The Notice must include the following information: (1) your name, (2) your address, (3) the email address you used for your reservation, (4) a brief description of the nature of your complaint, (5) the resolution you are seeking, and (6) your signature.
If we are unable to resolve your complaint within 60 days of receiving your Notice, you may commence an arbitration proceeding. Engaging in this pre-arbitration dispute resolution and notification process is a requirement that must be fulfilled before commencing arbitration. The arbitrator does not have authority to administer or adjudicate the Claim unless and until all pre-arbitration dispute resolution and notification requirements have been met. The statute of limitations will be tolled while the parties engage in the dispute resolution process required by this section.
Commencing arbitration
To initiate arbitration, you must file the Demand with the designated arbitration provider as specified in their rules. The arbitration provider provides a form Demand for Arbitration - Consumer Arbitration Rules at their website or by contacting them directly.
A party initiating an arbitration against Vuelos Caribe must send the written Demand for Arbitration to Legal Department/Dispute Resolution Provision, Vuelos Caribe, 7901 4th Street North, 300, St. Petersburg, FL 33702, concurrent with filing the Demand with the designated arbitration provider. Arbitration shall be conducted by a single arbitrator selected in accordance with the arbitration provider's rules or by mutual agreement between you and Vuelos Caribe. The arbitration shall be held either: (i) at a location determined by the arbitration provider pursuant to their rules (provided that such location is reasonably convenient for you and does not require travel in excess of 100 miles from your home or place of business); or (ii) at such other location as may be mutually agreed upon by you and Vuelos Caribe; or (iii) via videoconference; or (iv) at your election, if the only claims in the arbitration are asserted by you and are for less than $40,000 in aggregate, by telephone or by written submission.
Attorneys’ fees and costs
Your arbitration fees and your share of arbitrator compensation shall be governed by the arbitration provider's rules, and where appropriate, limited by their Consumer Rules. In order to initiate arbitration, each party will be responsible for paying the filing fees required by the arbitration provider, which are approximately equivalent to current court filing fees. In the event that you are able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, or you would otherwise be eligible for a fee waiver in court, Vuelos Caribe will pay as much of your filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive as compared to the costs of litigation, regardless of the outcome of the arbitration, unless the arbitrator determines that your claim(s) were frivolous or asserted in bad faith. Either party may make a request that the arbitrator award attorneys’ fees and costs upon proving that the other party has asserted a claim, cross-claim, or defense that is groundless in fact or law, brought in bad faith or for the purpose of harassment, or is otherwise frivolous, as allowed by applicable law and the arbitration provider's rules.
Arbitrator’s decision
There is no judge or jury in arbitration, and court review of an arbitration award is limited under applicable law. The arbitrator’s decision will include the essential findings and conclusions on which the arbitrator bases the award. Judgment on the arbitration award may be entered in any court with proper jurisdiction. The arbitrator may award any relief allowed by law or the arbitration provider's rules, but declaratory or injunctive relief may be awarded only on an individual basis and only to the extent necessary to provide relief warranted by the claimant’s individual claim.
Severability and survival
If any portion of this Disputes and Arbitration Provision is found to be unenforceable or unlawful for any reason, (1) such portion will be severed and the remainder of the Provision will be given full force and effect; and (2) to the extent that any Claims must therefore proceed on a class, collective, consolidated, or representative basis, such Claims must be litigated in a civil court of competent jurisdiction and not in arbitration, and the parties agree that litigation of those claims shall be stayed pending the outcome of any individual Claims in arbitration.

Section 15 General Governing law and jurisdiction
These Terms are governed by the Federal Arbitration Act, federal arbitration law, and the laws of the State of Florida, without regard to principles of conflicts of laws.
Insurance Unless otherwise stated, prices displayed do not include travel insurance. It is recommended that you obtain insurance covering certain cases of cancellation and specific risks (such as the cost of repatriation due to accident or illness). You are responsible for ensuring that any insurance policy adequately meets your needs. Certain travel insurance products may be offered to you, including details of the insurance provider, key information, and terms and conditions on our Service.
Failure to Enforce Our failure or delay in enforcing any provision of these Terms does not waive our right to enforce the same or any other provision(s) of these Terms in the future.
Unenforceable Provisions If any provision (or part provision) of these Terms is found invalid, illegal, or unenforceable by a court or competent authority, that provision (or part provision) shall, if necessary, be deemed not to be part of these Terms. This does not affect the validity and enforceability of the other provisions.
Entire Agreement These Terms constitute the entire agreement between you and Vuelos Caribe regarding our Service, superseding all prior or contemporaneous communications (whether electronic, oral, or written) between you and us.
Assignment Vuelos Caribe may assign, subcontract, or delegate rights, duties, or obligations under these Terms, but you may not.
Third-party Rights Except as expressly stated in these Terms, no part of these Terms is intended to be enforceable by any person who is not a party to them. No third-party's consent is required for waiver, variation, or termination of any part of these Terms. These Terms do not confer any rights under applicable laws or regulations for third parties to enforce any part of them.
Survival of Obligations Any provision of these Terms that imposes obligations beyond their expiration or termination shall survive such expiration or termination.
